DRAFT — pending legal review

Draft pending review by counsel. This text has not yet been reviewed by a lawyer and may change before it takes effect.

The short version

  • Veripres is free for patients, now and always.
  • During the pilot, doctors, clinics and pharmacies join only by invitation, and pay nothing.
  • Your health record is yours. Nobody sees it unless you approve, and you can stop sharing at any time.
  • Veripres is not for emergencies. In an emergency, call 112 or go to the nearest hospital.
  • Veripres does not give medical advice. Your doctor and your pharmacist make the medical decisions.
  • Veripres is a pilot. Things may change or go wrong, and our liability is limited (section 14).

1. About these Terms

1.1 Veripres is run by Obelisk Techno Solution Private Limited, a company registered in India with its registered office in Ahmedabad, Gujarat (CIN: to be added; registered office: registered office address to be added). In these Terms, "we", "us" and "our" mean that company.

1.2 These Terms apply to everyone who uses Veripres: patients, and the doctors, clinic staff, pharmacists and pharmacy owners we invite (together, "professionals").

1.3 Three other pages form part of your agreement with us: the Pilot Tester Terms (during the pilot), the Privacy Notice (how we handle personal data) and Consent and Sharing (how sharing works).

1.4 We ask you to accept these Terms when you create your account. If you do not agree with them, please do not use Veripres.

2. What Veripres is, and what it is not

2.1 Veripres is a health-record and e-prescription service. Patients keep their health record and their Veripres card on their phone. Doctors write visit notes and sign prescriptions digitally. Pharmacies open prescriptions when the patient approves, and record what they dispense.

2.2 Veripres is not a hospital, clinic or pharmacy. We do not diagnose, treat or prescribe, and we do not sell or deliver medicines.

2.3 The doctors, clinics and pharmacies on Veripres are independent of us. They are responsible for the care, advice and medicines they give.

2.4 Veripres is not for emergencies. It may be slow or unavailable at times, and nobody at Veripres watches records or messages for urgent medical problems. In an emergency, call 112 (or 108 for an ambulance), or go to the nearest hospital.

2.5 Some features rely on other services, such as your phone's passkey system, SMS and email delivery, and map links for clinic addresses. Those services have their own terms.

3. Who can use Veripres

3.1 Patients. Anyone can create a free patient account with their own mobile number and email address. You must be 18 or older to hold an account yourself. A child's account must be set up and managed by a parent or lawful guardian, as the Privacy Notice explains.

3.2 Professionals. During the pilot, professionals can join only by invitation. Before a doctor can open patient records or sign prescriptions, we check their medical registration. Before a pharmacy can open prescriptions, we check its drug licence and registered pharmacist. These are basic checks made when someone joins. They do not guarantee the quality of anyone's care.

3.3 If you accept these Terms for a clinic or pharmacy, you confirm that you have the authority to do so.

4. Your account

4.1 Give us true, up-to-date details. Keep your mobile number and email address current, because we send one-time codes only to them.

4.2 Patients sign in with a passkey (your phone's fingerprint, face or screen lock) or with a one-time code. Professionals sign in with an email address and password. Doctors and pharmacists also need a passkey. The Passkey and Biometrics Notice explains how passkeys work.

4.3 Keep your phone locked and your sign-in details private. Share a one-time code only with the doctor, clinic or pharmacy you are dealing with at that moment. Our staff will never ask you for a code.

4.4 You are responsible for what is done through your account. If you think someone else has used it, tell us straight away (section 17).

5. Fees

5.1 Veripres is free for patients, now and in the future.

5.2 Professionals pay nothing during the pilot. After the pilot, we plan to charge doctors and pharmacies a membership fee. We will tell you the price and terms in advance. You will not be charged unless you agree to them.

6. Your health record and sharing

6.1 Your health record is yours, and you decide who sees it. A doctor, clinic or pharmacy can see your information only after you share it in one of three ways: by showing the Live QR code on your Veripres card, by approving their request in the app or reading out a one-time code, or by confirming an appointment. Consent and Sharing explains each way, what each person sees and for how long.

6.2 You can stop any sharing at any time from the app. Every access is written to your access log, which you can see the same day.

6.3 Information you add yourself is marked as self-reported. Please keep it accurate. Doctors may rely on it, and a missing allergy or medicine could affect your care.

6.4 Once a doctor finalises visit notes or signs a prescription, they cannot be changed. A doctor can add a correction, which is shown together with the original.

7. Prescriptions

7.1 Doctors sign prescriptions digitally in Veripres. Each prescription comes as a PDF that you keep. You can show it at any pharmacy, including one that does not use Veripres. Veripres does not direct you to any particular pharmacy.

7.2 Each PDF carries a QR code that opens a public checking page. The page shows only the prescribing doctor and their registration details, the clinic, the dates, the number of medicines, and whether it has been dispensed. It never shows your name or your medicines.

7.3 The pharmacist decides whether to dispense. Some medicines have extra legal rules, and the pharmacist may need more than a Veripres prescription before dispensing them.

7.4 When a pharmacy opens your prescription, Veripres shows the doctor's preferred brand first, then only brands with exactly the same composition: the same medicines, in the same strengths, in the same form. The pharmacist chooses. Veripres never swaps a medicine on its own. If the doctor has locked a medicine to one brand, no other brands are shown.

8. Medical decisions stay with doctors and pharmacists

8.1 Veripres is a tool. It does not give medical advice. Your doctor and your pharmacist make all decisions about diagnosis, treatment, prescribing and dispensing, using their own professional judgement.

8.2 Safety checks in Veripres, such as allergy warnings, depend on what has been recorded. They can miss things. They do not replace professional judgement.

8.3 Medicine names, compositions, pack sizes and prices in Veripres come from public data. They may contain mistakes or be out of date. Always check the pack.

9. Extra rules for professionals

If you are a professional, you also agree:

9.1 to hold, and keep, the registration or licence your work requires, and to tell us within 2 working days if it is suspended, cancelled or changed;

9.2 to open a patient's information only to care for that patient, and only through sharing the patient has given;

9.3 to ask a patient for a one-time code only when they want to share with you at that moment, and never to ask for a code meant for someone else;

9.4 to keep patient information confidential, and not to copy, photograph, download or export it unless the patient's care needs it and the law allows it;

9.5 not to keep or rebuild a patient's information after the patient stops sharing or the access time ends;

9.6 to keep your directory listing accurate and factual;

9.7 to keep the records that the law and your professional rules require of you. Veripres keeps the patient's record for the patient. It does not replace records you must keep yourself. A pharmacy remains responsible for its dispensing register;

9.8 not to share your password or passkey, and to make sure everyone at your clinic or pharmacy uses their own account;

9.9 to tell us straight away if you suspect misuse of Veripres or a security problem.

9.10 You are responsible for your professional services, and for any claim that arises because you broke these Terms or the law.

10. Rules for everyone

Do not use Veripres to:

10.1 see, or try to see, anyone's information without their approval, or pretend to be someone else;

10.2 add information about another person without the right to do so;

10.3 upload anything unlawful, obscene, abusive, harassing or misleading, or anything harmful to children;

10.4 upload anything that belongs to someone else without their permission, or that infringes their rights;

10.5 upload viruses or harmful code, or attack, overload, probe or get around the security of Veripres;

10.6 copy, scrape, resell or reverse-engineer Veripres, except where the law allows it;

10.7 advertise, offer rewards, or pay or receive anything for patient referrals;

10.8 break any law in force in India.

11. Directory listings

11.1 Doctor and clinic listings show facts only, such as qualifications, registration details, languages, clinic addresses, timings and fees.

11.2 In line with National Medical Commission guidance, nobody can pay for a higher place in the directory, and listings carry no reviews, ratings, testimonials or promotional photos.

12. Ownership

12.1 The Veripres software, design and name belong to us.

12.2 You keep any rights you have in what you add to Veripres. You allow us to store, show and process it only to run Veripres for you and for the people you choose to share with, as the Privacy Notice describes.

13. Changes, suspension and leaving

13.1 Veripres is a pilot. We may change, pause or remove features. If a change affects how your information is shared, we will tell you before it takes effect.

13.2 We may suspend or close an account if we reasonably believe it is being misused, if we need to protect patients, or if we cannot confirm a professional's registration or licence. Where we can, we will tell you why.

13.3 You can stop using Veripres at any time. Patients can download their data and ask us to delete their account from the Consent centre. Professionals can tell us they want to leave, as the Pilot Tester Terms explain.

14. Limits on our liability

14.1 Veripres is a pilot. We provide it "as is" and "as available". As far as the law allows, we do not promise that it will always be available, free of errors, or suitable for any particular purpose.

14.2 We are not responsible for the medical or pharmacy decisions, advice or services of doctors, clinics and pharmacies.

14.3 We are not liable for indirect or unforeseeable losses, or for loss of profit, business or goodwill.

14.4 Our total liability to you for all claims about Veripres is limited to ₹10,000 (ten thousand rupees).

14.5 Nothing in these Terms limits liability that cannot be limited under Indian law. This includes liability for fraud, wilful misconduct or gross negligence, for death or personal injury caused by our negligence, and for our duties under data protection law. Nothing in these Terms takes away any rights you have under consumer protection law.

15. Law and courts

15.1 These Terms are governed by the laws of India.

15.2 The courts at Ahmedabad, Gujarat have exclusive jurisdiction over any dispute about these Terms or Veripres. This does not take away any right you may have under consumer protection law to bring a complaint where you live or work.

16. Changes to these Terms

16.1 We may update these Terms. Each version carries a version number and date.

16.2 We will tell you about an important change in the app at least 7 days before it takes effect, unless the change is needed sooner for legal or security reasons. Where the law requires, we will ask you to accept the new Terms. If you do not agree, you can stop using Veripres and delete your account.

17. Contact

17.1 For questions or complaints about these Terms or your personal data, contact our Grievance Officer, Grievance Officer (to be appointed), at grievance@veripres.example. The Grievance Officer page explains how.

17.2 By post: Obelisk Techno Solution Private Limited, registered office address to be added, Ahmedabad, Gujarat, India.
